Legal — Tranquil Traders

1. Risk Disclaimer

Trading involves substantial risk of loss and is not suitable for all investors.

Tranquil Traders provides educational content, software tools (including the Python Private Backtester and Pine Script indicators/strategies), and coaching services. Nothing on this website, in our products, or in any communication from us constitutes financial, investment, tax, or legal advice, nor a recommendation to buy, sell, or hold any security, cryptocurrency, or other financial instrument.

Hypothetical and backtested performance

Any performance results shown for the Bullish Pullback, Solid Move, or any other frameworks, including any comparison to a buy-and-hold benchmark, are based on hypothetical, backtested data. Backtested performance has inherent limitations: it is achieved with the benefit of hindsight and does not represent actual trading; it does not account for factors such as liquidity constraints, slippage, order execution delays, exchange fees, taxes, or market impact that would affect real results. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown. Past performance, whether actual or hypothetical, is not indicative of future results.

You are solely responsible for your trading decisions

Any use of the frameworks, strategy variants, signals, code, or coaching provided by Tranquil Traders is done entirely at your own discretion and risk. You are responsible for your own position sizing, risk management, execution, and compliance with the rules of any exchange, broker, or platform you use. Tranquil Traders does not execute trades on your behalf and does not manage funds.

No guarantee of results

We make no guarantee, warranty, or representation that use of our frameworks or materials will result in profit or will not result in loss. You should only trade with capital you can afford to lose, and you should consult a licensed financial advisor before making any investment decision. By using our products, you acknowledge that you understand these risks and agree that Tranquil Traders bears no liability for trading losses incurred through use of our materials.

No investment adviser or broker-dealer relationship

Tranquil Traders is not a registered investment adviser, broker-dealer, or commodity trading advisor with the U.S. Securities and Exchange Commission, the Commodity Futures Trading Commission, any U.S. state regulator, or any other regulatory body. Nothing provided constitutes personalized investment advice tailored to your individual financial situation. Coaching sessions are educational in nature and do not create a fiduciary or advisory relationship.

Assumption of risk

By purchasing or using any Tranquil Traders product, you knowingly and voluntarily assume all risk of financial loss associated with futures, equities, and cryptocurrency trading, and you release Tranquil Traders, its owners, employees, and affiliates from any claim arising out of trading decisions you make using our frameworks, code, or educational content.

2. Affiliate & Advertiser Disclosure

Some links on this website or in our communications may be affiliate or advertiser links. If you click one and make a purchase, we may receive a commission at no additional cost to you. We only recommend tools, brokers, platforms, or products that we have used ourselves or believe are genuinely useful to our audience.

This disclosure is provided in accordance with FTC guidelines on endorsements and affiliate marketing (16 CFR Part 255).

3. Testimonials & Performance Results Disclosure

In accordance with FTC Guidelines Concerning Use of Endorsements and Testimonials in Advertising (16 CFR Part 255):

  • Any testimonials, endorsements, or descriptions of past results from customers or members shown on this website, in our marketing, or in our community reflect that individual's personal experience only. These results are not typical, and you should not expect to achieve the same or similar results. Individual results vary significantly based on factors including experience, market conditions, capital, risk tolerance, and execution discipline.
  • Testimonials are genuine and unpaid unless otherwise disclosed. Where edited for length or clarity, edits do not change the substance of the statement.
  • Any hypothetical or backtested performance referenced elsewhere on this page (see Section 1) is separately and specifically disclosed as such, and is never presented as a guarantee or a typical outcome.

4. Terms of Service

Acceptance of terms. By accessing this website or purchasing any product, you agree to be bound by these Terms of Service. If you do not agree, do not use the website or purchase our products.

License to use. Upon purchase, you are granted a personal, non-transferable, non-exclusive license to use the purchased frameworks, code, video course, and related materials for your own individual trading. You may not resell, redistribute, sublicense, publicly share, or repackage any part of the frameworks, code, video content, or written materials without our prior written consent.

Intellectual property. All frameworks, strategy logic, code (Python and Pine Script), video content, written materials, and branding are the intellectual property of Tranquil Traders. Purchasing a product does not transfer ownership of this intellectual property to you.

Coaching services. 1:1 or small-group coaching is provided for educational guidance only. Coaching does not constitute personalized financial advice, portfolio management, or a guarantee of any outcome.

Account and access. You are responsible for maintaining the confidentiality of any login credentials or access links provided to you. You are responsible for all activity that occurs through your access.

Prohibited conduct. You may not use our products or services for any unlawful purpose, to infringe on the rights of others, or to reverse-engineer our materials for the purpose of redistribution.

Confidentiality. Any non-public framework logic, strategy rules, code, or coaching content we disclose to you is confidential and provided solely for your personal use. You agree not to disclose, publish, or share this confidential information with any other person or entity without our prior written consent, and to use the same reasonable care to protect it that you use to protect your own confidential information. This obligation survives termination of your access.

Modifications. We may update these Terms of Service, our products, or our pricing at any time. Continued use of the website or products after changes are posted constitutes acceptance of the updated terms.

Limitation of liability. To the maximum extent permitted by applicable law, Tranquil Traders and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including trading losses or lost profits, arising from your use of our products or services. In no event shall Tranquil Traders' total aggregate liability to you for any claim exceed the amount you actually paid for the product or service giving rise to the claim.

Indemnification. You agree to indemnify, defend, and hold harmless Tranquil Traders and its owners, employees, contractors, and affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of our products, your trading activity, or your violation of these Terms.

Disclaimer of warranties. Our products, code, and content are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the frameworks, code, or signals will be error-free or uninterrupted.

Binding arbitration and class action waiver. Any dispute arising out of or relating to these Terms or your purchase shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, conducted in [YOUR COUNTY, YOUR STATE], on an individual basis only. You and Tranquil Traders each waive the right to a jury trial and to participate in a class, collective, or representative action. Nothing in this clause waives any non-waivable right that applicable state law does not permit to be arbitrated away.

Severability. If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

Entire agreement. These Terms, together with the Risk Disclaimer, Privacy Policy, and Refund Policy on this page, constitute the entire agreement between you and Tranquil Traders regarding your purchase, superseding any prior agreements or representations.

Governing law. These Terms are governed by the laws of our home state, without regard to conflict-of-law principles, except where superseded by applicable federal law or a non-waivable local right described in Section 7.

5. Privacy Policy

This Privacy Policy describes how we collect, use, and protect your personal information, and reflects applicable U.S. and international privacy laws. See "Jurisdiction-Specific Notices" at the end of this page for the specific statutes and residency-based rights that apply to you.

Categories of personal information we collect

In the preceding 12 months, we may have collected the following categories of personal information:

  • Identifiers — name, email address, IP address
  • Commercial information — products purchased, purchase history
  • Payment information — processed by our third-party payment processor; we do not store full card numbers
  • Internet/network activity — pages visited, referral source, browser/device data, collected via cookies and analytics tools

We do not knowingly collect sensitive personal information (e.g., government ID numbers, precise geolocation, financial account login credentials) beyond what is necessary to process payment through our processor.

Purposes for collection

We use this information to: deliver purchased products and access; provide customer support and coaching scheduling; send product updates and promotional email (opt-out available at any time); maintain security and prevent fraud; and improve our website and offerings.

Sale or sharing of personal information

We do not sell personal information for money. We may share limited data (such as browser/device identifiers) with advertising or analytics partners for cross-context behavioral advertising. You may opt out below.

Your privacy rights

Depending on where you live, you have the right to:

  • Know what personal information we have collected, used, and disclosed about you
  • Delete personal information we have collected from you, subject to certain exceptions
  • Correct inaccurate personal information
  • Opt out of the sale or sharing of your personal information
  • Limit the use of sensitive personal information
  • Non-discrimination — we will not deny goods or services, charge different prices, or provide a different level of service because you exercised a privacy right

How to exercise your rights

Submit a verifiable request to [SUPPORT EMAIL] with the subject line "Privacy Request." We will verify your identity using the information associated with your account or purchase before responding, and will respond within the time required by law. You may designate an authorized agent to submit a request on your behalf. If we deny a request, you may appeal by replying to our denial with "Appeal" in the subject line.

Do Not Sell or Share My Personal Information

To opt out of any sharing for cross-context behavioral advertising, email [SUPPORT EMAIL] with "Do Not Sell or Share" in the subject line, or use any opt-out link provided in our marketing emails or on-site cookie banner.

Retention

We retain personal information only as long as necessary to fulfill the purposes described above, comply with legal obligations (including tax and accounting requirements), resolve disputes, and enforce our agreements.

Cookies

Our website uses cookies and similar tracking technologies to operate the site, remember preferences, and analyze traffic. You can control cookies through your browser settings and any on-site cookie preference tool.

Data security

We take reasonable administrative and technical measures to protect personal information but cannot guarantee absolute security of data transmitted over the internet.

Minors

Our website and products are directed at adults and not intended for use by anyone under 18. We do not knowingly collect personal information from minors under 16, and would not sell or share such information without opt-in consent as required by the CCPA.

Changes to this policy

We may update this Privacy Policy periodically. Material changes will be posted here with a revised "Last updated" date.

6. Refund Policy

ALL SALES ARE FINAL. NO REFUNDS.

Because Tranquil Traders' products consist of digital downloads, proprietary source code (Python and Pine Script), video course content, and instructional material that can be immediately accessed, copied, downloaded, and implemented upon purchase, no refunds, credits, or exchanges will be issued for any reason once a purchase is completed and access is granted — including but not limited to dissatisfaction with results, failure to achieve trading profits, failure to use the product, misunderstanding of what was purchased, or change of mind.

This no-refund policy applies equally to framework/code purchases, the video course, and coaching sessions once scheduled or delivered.

Pre-purchase acknowledgment required

This no-refund policy must be clearly and conspicuously displayed at the point of sale (e.g., directly on the checkout page, with a required checkbox such as "I understand all sales are final and non-refundable") before payment is accepted — see "Jurisdiction-Specific Notices" (Section 8) below for why this step is legally required, not optional, for our home-state business.

Chargebacks and payment disputes

Initiating a chargeback or payment dispute instead of contacting us directly is a violation of these Terms. Doing so will result in immediate termination of your access to all Tranquil Traders products and services, and we reserve the right to contest the dispute with your payment provider using records of product delivery and this policy.

Billing errors

The only exception to this policy is a genuine billing error (e.g., duplicate charge). Report billing errors to [SUPPORT EMAIL] within 30 days of the charge.

7. International & Multi-State Users

Our products are available for purchase by customers located anywhere in the United States and internationally. This section addresses what that means for you, wherever you're buying from.

No local registration or advice claim

Tranquil Traders is not registered as an investment adviser, broker-dealer, commodity trading advisor, or equivalent regulated entity in any U.S. state, or in any country outside the United States. Nothing we provide should be construed as a solicitation or offer to buy or sell any security, future, or cryptocurrency in any jurisdiction where such solicitation would be unlawful. You are solely responsible for determining whether your use of our products complies with the laws and regulations of your own country, state, or province, including any local rules governing trading education, financial promotions, or investment advice.

Eligibility

You must be of legal age (18, or the age of majority in your jurisdiction if higher) to purchase or use our products. By purchasing, you represent that you meet this requirement and that you are not accessing our products from, or a resident of, a country or region subject to comprehensive U.S. trade sanctions or export restrictions (including but not limited to any country on the U.S. Treasury OFAC sanctions list), and that you are not listed on any U.S. government denied-party or sanctions list.

Non-waivable local consumer rights

The "all sales final" refund policy in Section 6 is intended to apply to the fullest extent permitted by law. If you reside in a jurisdiction (including EU/EEA/UK member states, or a U.S. state) that grants a non-waivable statutory right to a refund, cooling-off period, or similar consumer protection that cannot lawfully be waived by contract, nothing in this policy is intended to override that non-waivable right, and the minimum protection required by your local law will apply instead.

GDPR / UK GDPR (EU, EEA, and UK residents)

If you are located in the European Economic Area or United Kingdom, the following applies in addition to Section 5:

  • Legal basis for processing. We process your personal data on the basis of contract performance (to deliver purchased products), legitimate interest (site security and improvement), consent (marketing emails, certain cookies), and legal obligation (tax/accounting records).
  • International data transfer. Because Tranquil Traders operates from the United States, your data will be transferred to and processed in the U.S. We rely on Standard Contractual Clauses or an equivalent lawful transfer mechanism where required.
  • Your rights. In addition to the rights listed in Section 5, EEA/UK residents have the right to access, rectify, erase, restrict, or port their personal data, to object to processing based on legitimate interest, to withdraw consent at any time, and to lodge a complaint with your local data protection authority.
  • Requests. Submit requests to [SUPPORT EMAIL]. We will respond within the timeframe required by applicable law.

Currency and taxes

All prices are listed in U.S. dollars unless stated otherwise. You are responsible for any currency conversion charges, VAT, GST, customs, or import-related fees applicable in your jurisdiction. Where required by law (e.g., EU VAT on digital services), applicable tax will be collected at checkout.

8. Jurisdiction-Specific Notices

Tranquil Traders is operated from California. Because of that, a few disclosures below are specific to California law, and apply to you if you're a California resident — they sit here rather than repeated throughout the page:

Governing law and venue

These Terms are governed by California law, and arbitration under Section 4 is seated in California.

Refund disclosure (Civil Code § 1723)

Our "all sales final" policy must be conspicuously displayed at checkout with an acknowledgment step, as described in Section 6 — this is a California requirement on us as the seller.

Consumer complaints (Civil Code § 1789.3)

California users may direct complaints to the Complaint Assistance Unit, Division of Consumer Services, California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, (800) 952-5210.

CCPA/CPRA

The privacy rights in Section 5 (know, delete, correct, opt out, limit, non-discrimination) are granted specifically under California's CCPA/CPRA.

"Shine the Light" (Civil Code § 1798.83)

California residents may request, once per year, what personal information we've shared with third parties for their direct marketing. We don't currently do this; if that changes, this page will be updated.

If you're outside California, these specific citations don't apply to you directly, but the general Terms, Privacy Policy, and Refund Policy above still govern your purchase — along with Section 7 for anything specific to your own location.

9. Free Trading Signals Group

Access to our free trading signals chat ("Signals Group") is provided to you at no cost, at our sole discretion, and is subject to the Risk Disclaimer (Section 1) in full, as well as the additional terms below.

Nature of the signals

Signals posted in the Signals Group are labeled by number (e.g., "Signal 1," "Signal 2") and correspond to specific proprietary trading strategies developed by Tranquil Traders. The underlying entry rules, exit rules, filters, and logic behind each numbered signal are confidential and are not disclosed in the Signals Group. Detailed methodology is available only to customers of our paid framework offering.

Educational purpose only

Signals and any accompanying commentary are provided for educational and informational purposes only. They do not constitute financial, investment, tax, or legal advice, nor a personalized recommendation to buy, sell, or hold any security, cryptocurrency, or other instrument. Nothing about your participation in the Signals Group creates an investment adviser, broker-dealer, or fiduciary relationship, consistent with Section 1.

Backtest history

Any backtest history, equity curves, or performance statistics shown for Signal 1, Signal 2, or any other numbered signal are hypothetical and backtested, and are subject to the same limitations disclosed in Section 1 (hindsight bias, no accounting for slippage/fees/liquidity, no guarantee of similar future results). This backtest history illustrates how a strategy has performed historically and is not a projection or guarantee of future signal performance.

No guarantee, your own risk

We do not guarantee the timeliness, accuracy, or completeness of any signal. Signals may be delayed, missed, delivered late, or discontinued without notice. You are solely responsible for any trading decisions made in connection with a signal, including position sizing, execution, and risk management, consistent with Section 1.

Confidentiality and no redistribution

Signals and backtest data shared in the Signals Group are for the personal use of group members only. You agree not to redistribute, repost, screenshot for public sharing, or resell signals or backtest data outside the group without our prior written consent, consistent with the confidentiality terms in Section 4.

No obligation to continue

The Signals Group is offered free of charge and may be modified, paused, or terminated at any time, and your access may be revoked at our discretion, without liability to you.
